Consent to receive marketing communications

This document constitutes your explicit consent to receive marketing and promotional communications from The Storly, operated at https://thestorly.com/. Please read this document carefully before providing your consent.
This consent is voluntary. You may refuse to provide consent or withdraw it at any time without any consequences for your access to the Service or your contractual rights with The Storly.

The Storly is the data controller responsible for your personal data used in marketing communications.

2. Types of Marketing Communications Covered
By providing your consent, you agree to receive the following types of marketing communications:
2.1 Email Marketing
- Product news and feature announcements
- Promotional offers, discounts, and limited-time deals
- Tips, tutorials, and educational content related to carousel creation and social media growth
- New template releases and niche-specific content
- Platform updates and roadmap previews
- Occasional surveys and feedback requests
2.2 Push Notifications
- In-app and browser push notifications about new features and product updates
- Personalized recommendations based on your usage (e.g., new templates matching your niche)
- Promotional alerts and time-sensitive offers
- Re-engagement messages if you have not used the Service for a period of time
We will clearly label all marketing communications so you can distinguish them from transactional or service messages (such as billing receipts and password resets). Transactional messages are sent regardless of this consent.
3. Personal Data Used for Marketing
To send you relevant marketing communications, we may process the following personal data:
- Email address
- Name (for personalization)
- Niche/industry selected during onboarding
- Social platforms you use (e.g., Instagram, LinkedIn)
- Subscription plan and usage data (to tailor offers and tips)
- Device token or browser subscription ID (for push notifications)
- Language preference
We do not use your carousel content or voice recordings for marketing personalization without your separate consent.
4. Legal Basis for Processing
The legal basis for processing your personal data for marketing purposes is your explicit consent as provided by:
- Article 6(1)(a) GDPR — consent of the data subject (for users in the EEA, UK, and Switzerland)
- CAN-SPAM Act — opt-in consent for commercial email (for users in the United States)
- CASL — express consent for commercial electronic messages (for users in Canada)
- Federal Law No. 38-FZ "On Advertising" — subscriber consent (for users in Russia)
5. Communication Frequency
We aim to send marketing emails no more than 2–4 times per month. Push notification frequency depends on your activity and will not exceed 1–2 per week for promotional content.
We reserve the right to adjust frequency and will notify you of any significant changes.
6. Right to Withdraw Consent
You may withdraw your consent at any time, free of charge, without providing a reason, using any of the following methods:
6.1 Email Marketing
- Click the "Unsubscribe" link included in every marketing email
- Adjust your notification preferences in your account Settings → Notifications
6.2 Push Notifications
- Turn off push notifications in your browser or device settings at any time
- Adjust preferences in your account Settings → Notifications
Withdrawal of consent does not affect the lawfulness of any marketing communications sent before you withdrew consent. After withdrawal, we will process your opt-out within 10 business days.
Withdrawing marketing consent does not affect your right to continue using The Storly or your subscription.
7. Retention of Consent Record
We retain a record of your consent (timestamp, method, and consent text version) for as long as your account is active and for 3 years after withdrawal, as required for legal compliance and to demonstrate consent was properly obtained.
Your email address and marketing preferences are retained until you withdraw consent or delete your account.
8. Third-Party Service Providers
We use trusted third-party providers to deliver marketing communications on our behalf:
- Resend — email delivery platform
These providers act as data processors under our instructions and are contractually bound to protect your data. They are not permitted to use your data for their own marketing purposes.
9. International Data Transfers
Your data may be transferred to and processed in countries outside your country of residence in connection with the delivery of marketing communications. Such transfers are protected by appropriate safeguards, including Standard Contractual Clauses (SCCs) or equivalent mechanisms as required by applicable law.
10. Your Rights
In addition to the right to withdraw consent at any time, you have the following rights regarding personal data processed for marketing purposes:
- Right to access the personal data we hold about you
- Right to rectification of inaccurate data
- Right to erasure (deletion) of your data
- Right to restriction of processing
- Right to data portability
- Right to lodge a complaint with your local data protection authority

11. Changes to This Consent Form
If we materially change the nature or scope of marketing communications covered by this consent, we will notify you and ask you to renew your consent before such changes take effect.
